What is a statute of limitations?

The statute of limitations is a legal concept that sets a specified period within which you must file a lawsuit regarding a particular dispute. As outlined in New Jersey Statutes section 2A:14-2, the statute of limitations for personal injury claims is set at two years from the date the injury occurred. With few exceptions, a claim would be barred after that point.

Are there limits on how much a person can receive in a personal injury lawsuit?

Many states have imposed limits on the amount of compensatory damages (which include both economic and noneconomic compensation), but New Jersey has not – not even in medical malpractice claims. Only punitive damages, when awarded, may be capped.

What are noneconomic damages?

Noneconomic damages refer to intangible losses in a personal injury case, such as pain and suffering, emotional distress or loss of enjoyment of life. In New Jersey, individuals filing a personal injury claim can seek compensation for both economic and noneconomic losses related to their injuries.

What are punitive damages?

Punitive damages aim to punish the defendant for outrageous misconduct and deter similar behavior in the future. According to N.J.S.A. 2A:15-5.9, punitive damages sought in a case are capped at either five times the amount of compensatory damages awarded or $350,000, whichever is greater. However, exceptions exist for cases involving public policy and social concerns, where punitive damages may be determined case by case without this limit.
